Terms and Conditions

XTREME JET TERMS AND CONDITIONS OF PARTICIPATION 

Xtreme Jet Bay of Islands Limited (“Xtreme’) appreciates your custom and aims to provide a friendly, exciting and safe experience in our beautiful Bay of Islands.  In participating in this activity, you, the passenger (“you”), agree to the following terms and conditions: 

  1. Participation in all adventure activities carries a degree of inherent risk and by participating in the activity provided by Xtreme you are expressly assuming those risks personally and are, to the maximum extent permitted by law, waiving and releasing Xtreme and its officers and employees from any liability, claims, losses, damages or expenses caused by any event including, but not limited to: 
  2. Personal injury or death; 
  3. Property loss or damage; 
  4. Acts which may be construed as negligent or accidental; 
  5. Any other loss, damage, suffering, emotional or nervous disorder. 
  6. You confirm that you are physically fit and suffer no medical conditions which may be aggravated by this activity.  Please be aware that inevitably you may be subject to a high level of jolting and sudden movement and if you have any injury or condition that may be aggravated by this you should not take part in the trip. Therefore, if you have had any previous or ongoing back/neck injuries or you are Pregnant, DO NOT PARTICIPATE in this activity 
  7. You agree to listen to the driver, follow his or her instructions and make sure any children in your care do the same.  Xtreme reserves the right to remove or to refuse to allow any passenger to participate who does not comply with instructions or who is deemed to be a nuisance, acting recklessly or otherwise considered to be unsuitable to participate. 
  8. You acknowledge that use of recording devices of any nature whatsoever (cameras, phones, videos etc) are strictly prohibited during the activity for passenger and property safety, other than as specifically allowed by the driver.  Xtreme may make a recording of the activity and in such case you consent to the unrestricted use of that recording by Xtreme for any purpose without limitation. 
  9. You consent to receive medical treatment in the case of injury, accident or illness during the activity and to indemnify Xtreme against any claims in respect of this treatment. 
  10. You agree that your successors, executors, administrators and next of kin are bound by these terms and conditions. 
  11. You agree the laws and courts of New Zealand apply exclusively to these terms and conditions and you agree not to commence any litigation or proceedings in any country in relation to the risks and perils set out in clause 1 above and to indemnify Xtreme against any such claims.  In the event that any liability is attributed to Xtreme, such liability is limited to the price paid by you to Xtreme for the activity. 

 

CANCELLATION AND REFUND POLICY 

Xtreme Jet Bay of Islands Ltd reserves the right to cancel trips due to bad weather or unsafe conditions. In this event alternative arrangements will be made to accommodate our passengers in the form of re-booking or a full refund.  At least 24 hours’ notice must be given for customer cancellation to be valid for refund.  If cancellation is within 24 hours of the booking a 50% cancellation fee will apply.  No-shows will incur a 100% cancellation fee. 

 

Once an Xtreme Jet Bay of Islands Ltd product has been booked and paid for this is non-transferrable and non-refundable unless authorised by management at their discretion or due to Xtreme cancellation as stated above. 

 

Refunds by Xtreme are only applicable if payment was originally direct to Xtreme Jet Bay of Islands Ltd.  Refunds to credit cards must be done at the Xtreme Jet Bay of Islands booking facility with original card used for the booking or a New Zealand bank account number must be provided for direct debit.  Selling agents must be contacted individually by the customer and their refund policies will apply. 

 

All other refunds are reviewed by Xtreme on a case by case basis and we have the right to refuse a refund if we see the reasoning as invalid.  If applicable a refund request form will be issued.
